CRITICAL DISCLAIMER: The locations, markers, and "pins" found on this Service are generated by users. DroneSpot does not verify the legality, safety, or accessibility of any location. The presence of a location on this map does not constitute legal permission to enter that property or authorization to fly within that airspace.
3. Pilot Responsibilities and Compliance
By using this Service, you explicitly acknowledge and agree that:
- Pilot in Command: You are the sole "Pilot in Command." You bear full legal and safety responsibility for every flight you conduct.
- Regulatory Compliance: It is your responsibility to check and comply with all local, state, and federal regulations (e.g., FAA Part 107, TRUST, LAANC authorization, EASA regulations) before flying.
- Airspace Verification: You must independently verify airspace classifications and restrictions using official government sources (such as FAA B4UFLY, Aloft, or equivalent in your country) regardless of what this Service indicates.
- No Legal Advice: Information provided on this Service is for recreational reference only and does not constitute legal advice.
4. Trespassing and Private Property
DroneSpot strictly prohibits the use of drones for illegal trespassing.
- Verification: The presence of a "pin" or spot on our map does not imply that the land is public or that the landowner has granted permission for drone operations.
- User Duty: You are responsible for verifying land ownership and obtaining necessary permissions before entering any property or launching a drone.
- Liability: DroneSpot assumes no liability for users who trespass, damage property, or violate privacy laws based on information found on the Service.
5. User-Generated Content (UGC)
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content").
- License to Us: You retain ownership of your Content. However, by posting it, you grant DroneSpot a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display said Content in connection with the Service (e.g., displaying your spot photos to other users).
- Prohibited Content: You agree not to post Content that encourages illegal acts (e.g., "Here is how to break into this fence"), contains hate speech, harassment, or explicit material, or violates the privacy or intellectual property rights of others.
- Right to Remove: We reserve the right to remove any Content or delete any spot listing at our sole discretion, without notice.
6. Accounts and Subscriptions
- Account Security: You are responsible for safeguarding the password that you use to access the Service.
- Free & Paid Tiers: DroneSpot may offer both free and paid ("Premium") tiers. We reserve the right to modify the pricing or features of these tiers at any time.
- Termination: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall DroneSpot, its founders, affiliates, agents, or employees be liable for:
- Physical Damage/Injury: Any injury, death, or property damage resulting from your use of a location found on the Service.
- Legal Consequences: Any fines, citations, arrests, or legal action taken against you by government authorities (e.g., FAA, Police) or private property owners.
- Data Accuracy: Any errors, mistakes, or inaccuracies of content.
- Equipment Loss: Loss or damage to your drone or equipment while flying at locations listed on the Service.
YOU USE THIS SERVICE ENTIRELY AT YOUR OWN RISK.
8. Indemnification
You agree to defend, indemnify and hold harmless DroneSpot and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from your use and access of the Service, a violation of these Terms, your violation of any third-party right, including property or privacy rights, or any claim that your User Content caused damage to a third party.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
